Organizational Location: This attorney position is located in the Department of Homeland Security (DHS), Immigration and Customs Enforcement (ICE), Office of the Principal Legal Advisor (OPLA), Government Information Law Division (GILD), Washington, DC.

Office of the Principal Legal Advisor (OPLA) is the legal arm of ICE, the largest investigative agency of DHS, and provides expert mission-critical legal services, counsel, and training to support ICE initiatives and programs vital to protecting U.S. national security. OPLA is the principal legal representative for DHS/ICE in a variety of courts and forums.

The Government Information Law Division (GILD) is a subordinate Division within OPLA. GILD is responsible for providing legal advice on all matters relating to the disclosure of agency information both within and outside the U.S. Department of Homeland Security (DHS). To that end, GILD works closely with ICE's Freedom of Information Act (FOIA) Office and the U.S. Department of Justice in coordinating the agency's response to FOIA litigation. GILD attorneys also adjudicate FOIA appeals and are responsible for working with the ICE FOIA Office to review their work at the administrative level and act as counsel on the appeals. GILD attorneys also provide critical legal support by ensuring that law enforcement efforts are compliant with disclosure, privacy, and records management requirements. GILD attorneys handle third party requests or subpoenas for agency testimony and documents which entails corresponding with parties and subpoenaed employees, reviewing requested documents, redacting documents to preserve privileges, and preparing declarations in support of privileges asserted. GILD also handles a vast array of additional disclosure-related issues, including: federal, state, and foreign requests for information; privacy issues; and, reviews of national and international agreements. The division also provides crucial assistance in responding to Congress, media outlets, and other entities, and defends the agency against information disclosure and Privacy Act litigation.

Responsibilities

The duties of the position include (1) supporting the Chief in managing all substantive and personnel matters relating to GILD; (2) the leadership of attorney and support staff; (3) strategic planning; (4) the quality control of attorney written work product; (5) the provision of technical legal guidance to attorney staff in the areas of information disclosure to include the Freedom of Information Act, the Privacy Act, the Paperwork Reduction Act, the E-government Act, and the Federal Records Act; (6) the oversight of legal advice to the other ICE components and litigation support to U.S. Attorneys' Offices in the areas of information disclosure to include the Freedom of Information Act, the Privacy Act, the Paperwork Reduction Act, the E-government Act, and the Federal Records Act; (7) the management of financial resources, including budget formulation and execution; and (8) briefing and providing legal advice to senior OPLA management and senior ICE management on emerging and high profile issues. In addition to the supervision of legal work within the Division, the Deputy Chief will also be expected to maintain an active caseload.

The work is diverse, fast-paced and requires the ability to work closely and diplomatically with federal and state agencies and law enforcement partners; prioritize multiple assignments; exercise sound legal judgment; efficiently produce quality legal analyses of complex issues; and work effectively both independently and as part of a team.

Qualifications

Trial Period: New attorneys to the Federal government will be required to serve a trial period of 2 years. New supervisors will be required to serve a one (1) year probationary period.
